Terms of Service

1. About these Terms

These Terms of Service ("Terms") govern your use of the Grinta app and related services (the "Service"). Grinta is a football app operated by Tonsser ApS, CVR no. 35472088, c/o Peter Holm Nielsen, Peder Pårs Vej 20, 9000 Aalborg, Denmark ("Tonsser", "we", "us").

By creating an account or using Grinta, you agree to these Terms and confirm you have read the Grinta Privacy Policy. If you do not agree, do not use Grinta.

2. Eligibility, age and parental consent

You must be at least 13 years old to use Grinta.

If you are under the age at which you can consent to data processing where you live (13 in Denmark, Sweden and the United States, up to 16 in some EU countries), a parent or legal guardian must consent before you can use Grinta. We ask for that consent during sign-up and may verify it.

If you are under 18, your parent or guardian must also agree to these Terms on your behalf and is responsible for supervising your use.

If we learn that a user is under 13, or signed up without required parental consent, we will close the account and delete the related data. Parents can contact us at privacy-grinta@tonsser.com.

3. Your account

Give accurate information and keep it up to date.
Keep your login details secure. You are responsible for activity on your account.
One person, one account. Do not share, sell or transfer it.
Tell us at grinta@tonsser.com if you think someone has accessed your account without permission.

You may be able to use the same Tonsser login for other Tonsser apps. Your Grinta profile and activities stay separate and are not shown in other apps.

4. The Service: activity logging and AI coaching

Grinta lets you log training, games and other activities, add reflections, and receive personalised guidance generated by artificial intelligence ("AI Coaching").

How AI Coaching works. AI Coaching uses the activities, reflections and profile information you provide to suggest training ideas, objectives and feedback. Suggestions are generated automatically and may be inaccurate, incomplete or unsuitable for you.

AI Coaching is not professional advice. It does not replace a qualified coach, doctor, physiotherapist or other professional. Use your own judgement and ask a qualified adult or professional before changing your training, especially if you are young, injured or have a health condition.

AI providers. We use third-party AI providers to generate AI Coaching, as explained in the Privacy Policy. They are contractually prevented from using your data to train their own models.

5. Health, safety and risk

Football involves a risk of injury. You take part in any training, game or activity at your own risk and are responsible for doing it safely.

Stop and seek help if you feel pain, dizziness or discomfort.
Follow the rules of your club, school, coach and venue.
Do not use the app in a way that distracts you while moving, driving or crossing roads.

Grinta is not a medical device and does not diagnose, treat or prevent any condition.

6. Acceptable use

You must not:

harass, bully, threaten or discriminate against anyone;
upload content that is sexual, violent, hateful, illegal or that shows another person without their permission;
contact or try to meet minors for any inappropriate purpose;
pretend to be someone else, including a coach, club, player or Tonsser representative;
upload false activity data to manipulate objectives, progress or rewards;
copy, scrape, reverse-engineer or interfere with the Service, or use bots to access it;
try to make AI Coaching produce harmful, unsafe or misleading content;
use Grinta for commercial purposes without our written permission.

We may remove content, limit features or suspend accounts that break these rules. Report concerns to report-grinta@tonsser.com.

7. Your content

You keep ownership of the activities, reflections, text, photos and videos you add ("Your Content").

You give Tonsser a worldwide, non-exclusive, royalty-free licence to host, store, process, display and adapt Your Content to run, improve and secure Grinta, including to provide AI Coaching. This licence ends when you delete Your Content or your account, except where we must keep data by law or as described in the Privacy Policy.

We will not use Your Content, your name or your image in marketing outside the app without your separate consent (and a parent's consent if you are under 18).

You confirm you have the right to share Your Content and that it does not break these Terms or anyone else's rights.

8. Our intellectual property

Grinta, including its software, design, AI Coaching outputs, training content and the Grinta and Tonsser names and logos, belongs to Tonsser or our licensors. We give you a personal, non-transferable, revocable licence to use Grinta for your own non-commercial use under these Terms.

Names and logos of clubs, federations or other third parties shown in Grinta belong to their owners. Showing them does not mean those organisations endorse you or Grinta, unless we say so.

9. Partner programmes

You may join Grinta through a partner such as a federation, academy, school or club. That partner's own rules may also apply, and we will tell you what information, if any, is shared with them.

10. Beta features, changes and availability

Some features are offered as a beta or pilot. They may change, contain errors or be removed.

We may update, add or remove features and may not offer every feature in every country. We aim to keep Grinta available but do not guarantee it will be uninterrupted or error-free. We will give reasonable notice of major changes that affect you.

11. App stores

If you download Grinta from the Apple App Store or Google Play, these Terms are between you and Tonsser, not Apple or Google. Apple and Google have no obligation to provide support or maintenance for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must also follow the app store's own terms.

12. Ending your use

You can delete your account at any time in the app settings or by emailing grinta@tonsser.com.

We may suspend or close your account if you seriously or repeatedly break these Terms, if required by law, or to protect users. Where reasonable, we will tell you why first. We may close Grinta entirely with at least 30 days' notice.

Sections 7, 8, 13 and 14 continue to apply after your account ends, as relevant.

13. Disclaimers and liability

Your legal rights come first. Nothing in these Terms limits rights you have as a consumer under the law of the country where you live, including EU consumer law.

Grinta, including AI Coaching, is provided "as is". To the extent permitted by law, we do not promise that it will meet your needs or that AI Coaching will be accurate.

To the extent permitted by law, Tonsser is not liable for indirect or unforeseeable loss, or for injury resulting from activities you choose to do. Our total liability to you is limited to the greater of the amount you paid us in the 12 months before the claim and EUR 100.

We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law.

14. Governing law and disputes

These Terms are governed by Danish law and disputes go to the Danish courts. If you are a consumer in the EU, you keep the protection of the mandatory laws of your country and may bring a claim in your local courts.

Please contact us first at grinta@tonsser.com so we can try to resolve any issue. EU consumers can also use their national consumer complaint bodies.

15. Changes and contact

We may update these Terms. If a change is significant, we will notify you in the app or by email at least 30 days before it takes effect. If you keep using Grinta after that, the new Terms apply. If you do not agree, you can delete your account.
